GSTR-3B Late Filing: Penalty, Interest & How to File

By GovYapar CA Team · March 2026 · 8 min read

🚨 Late GSTR-3B attracts ₹50/day late fee + 18% annual interest on unpaid tax. Don't let it compound. File today.

Missed your GSTR-3B deadline? You're not alone — thousands of businesses file late every month. The good news: you can still file, pay the penalty, and get back on track. This guide tells you exactly what you owe and how to do it.

What is GSTR-3B?

GSTR-3B is a monthly self-declaration return where you report your total GST liability, claim Input Tax Credit (ITC), and pay the net tax due. It's filed by the 20th of the following month for monthly filers (e.g., February 2026 GSTR-3B is due March 20, 2026).

Late Fee for GSTR-3B

The late fee structure depends on whether your return has a tax liability or is a nil return:

ScenarioLate fee per dayMaximum cap
Nil return (no tax liability)₹20/day (₹10 CGST + ₹10 SGST)₹500
Return with tax liability₹50/day (₹25 CGST + ₹25 SGST)₹10,000

Late fee accrues from the day after the due date. For example, if February GSTR-3B was due March 20 and you file March 30, you pay 10 days × ₹50 = ₹500 late fee (assuming you have tax liability).

Interest on Unpaid GST

In addition to the late fee, if you had outstanding tax to pay that wasn't paid by the due date, you owe 18% per annum interest on the unpaid amount, calculated daily.

Formula: Interest = Unpaid tax × 18% ÷ 365 × number of days delayed

Example: ₹50,000 unpaid tax for 30 days = ₹50,000 × 18% ÷ 365 × 30 = ₹739

Step-by-Step: How to File Overdue GSTR-3B

Step 1 — Log in to the GST Portal

Visit gst.gov.in and log in with your GSTIN and password.

Step 2 — Go to Returns Dashboard

Navigate to Services → Returns → Returns Dashboard. Select the financial year and the tax period you missed.

Step 3 — Prepare GSTR-3B

Click on GSTR-3B. Enter your outward supply details (Table 3.1), ITC details (Table 4), and other adjustments. The portal auto-calculates your net tax liability.

Step 4 — Pay Late Fee & Tax

Before filing, pay the late fee and any outstanding tax through the GST payment portal (using net banking, UPI, or challan). The late fee will be pre-populated automatically.

Step 5 — Submit and File

Preview your return, verify using EVC (OTP) or DSC, and submit. You'll receive an ARN (Acknowledgement Reference Number) on successful filing.

Pro tip: Always file GSTR-1 before GSTR-3B for the same period. Auto-populated figures in 3B come from GSTR-1, making the filing faster and reducing errors.

How to Avoid Late Filing in Future

The simplest way is to set calendar reminders for the 11th (GSTR-1) and 20th (GSTR-3B) of every month. Alternatively, use GovYapar's compliance dashboard — it sends WhatsApp reminders before every deadline and auto-alerts you if a filing is at risk.

Never miss a GST deadline again.

GovYapar's CA team files your GSTR-1 and GSTR-3B every month. Zero penalties guaranteed.

Frequently Asked Questions

Can late fee be waived?

The government occasionally issues late fee amnesty schemes for specific periods. Check the latest GST council notifications. However, interest on unpaid tax is generally not waived.

What happens if I don't file GSTR-3B at all?

Beyond late fees and interest, persistent non-filing can lead to your GST registration being suspended or cancelled, blocking your ability to issue invoices and claim ITC. Continued default may also result in legal proceedings under Section 122 of CGST Act.

Can I file GSTR-3B without filing GSTR-1?

Yes, technically you can file GSTR-3B independently. However, ITC auto-population from GSTR-2B depends on your suppliers' GSTR-1 filings, and you should still reconcile manually before filing.
