The appeal ladder
A GST dispute moves through defined levels — first an appeal to the Appellate Authority, then to the GST Appellate Tribunal (GSTAT), and higher courts beyond that. Each level has its own form, fee and, importantly, its own deadline.
Two things that trip businesses up
- Deadlines: appeals must be filed within a set period from the order — miss it and your appeal can be rejected outright.
- Pre-deposit: you usually must deposit a percentage of the disputed tax before your appeal is heard.
How to prepare a strong appeal
- Keep the original order and all correspondence.
- Build a clear, fact-based reply with supporting reconciliations and invoices.
- File well before the deadline — never on the last day.
- Get expert help where the amount or complexity is significant.
An appeal is winnable when it's timely, well-documented and correctly framed. The most common reason good cases fail is a missed deadline, not a weak argument.
